I'm very surprised that daycare providers are allowed to smoke around the children. In the UK, schools and nurseries are smoke free (the one classroom assistant in Freddie's school who smokes not only has to go outside to smoke but has to walk off the school's grounds as well). I would be very surprised if registered day care providers are allowed to smoke near the children (if they are not registered the state will not help with the parent's costs).
Surely it's not too hard for a smoker to arrange to smoke away from the children - before Paul gave up smoking he would go outside before he lit up. It actually helped him cut down as it meant he had to make a conscious decision to have a cigarette rather than just lighting up without thinking. (Before anyone accuses me of nagging he made the decision to not smoke near the kids without any input from me!)
